Terms of use
Last updated: 19 October 2026
This is an English translation for your information. The contract is made in Spanish and, if the two versions differ, the Spanish version applies.
These terms govern the use of Taraceista and the purchase of its plans. If anything is unclear, write to us at hola@taraceista.com.
1. Who provides the service
Jesús Marín Almansa, tax ID (NIF) 26530658C, under the trade name Taraceista, with address at Calle Alondra, 13, 2.º E, 18014 Granada, Spain. Phone: 614 03 39 84. Email: hola@taraceista.com, which is also the point of contact for users and authorities, in Spanish or in English.
2. The service
Taraceista uses artificial intelligence to build your business's website, hosts it and lets you change it by asking in your own words. It includes a panel to manage it, the website's forms and statistics, and whatever each plan states. It is an online service: it works while it is contracted.
It is designed for businesses and professionals of legal age. If you sign up on behalf of a company, you declare that you can bind it. If you are a consumer, you also have the rights in section 15.
3. How you sign up
- You create an account and accept these terms and the privacy policy. With that you have the Free plan.
- If you want a paid plan, you choose it in the panel whenever you like and pay by card. Before confirming the payment you see the plan, its price including VAT and how often it is charged, and you can correct any detail.
- We send you the confirmation by email. The invoice stays in your panel.
- The contract is made in Spanish. We keep the version of these terms you accepted and the date, and we give it to you if you ask.
4. The Free plan
- It has no end date, does not ask for a card and is not charged.
- It includes one website, published at a taraceista.app address, and 5 changes a month. The first month includes 5 extra changes as a gift: 10 in total.
- It does not include your own domain: we neither register one for you nor can you connect one you already have. That is why it does not include domain email either. Downloading the website comes with the first payment, as section 11 says.
- If you run out of changes, you can buy 5 more for 5 €, or move to a paid plan from the panel.
- There is one Free account per person or business.
5. Plans and prices
What each plan includes (changes a month, number of websites, space, domain, email and support) and its price are those shown on the plans page at the time you sign up. Prices include VAT.
- A change is each request you make in the workshop, even if it asks for several things at once. It counts when it starts, also if the result is not useful to you. If it fails because of an error on our side, write to us and we will give it back.
- The monthly allowance of changes renews on the 1st of each month. What is not used does not carry over to the next month.
- The domain, if your plan includes one, is registered in your name. How it is registered, renewed and transferred is in section 6.
- Your domain email: paid plans include 3 email accounts on each domain. Each extra account costs 2 € a month, or 24 € a year if your plan is annual. Each account has a daily sending limit and cannot be used for mass mailing.
- Features in testing: those marked as such may fail, change or disappear, and are not covered by the plan's support.
6. Your domain
If your plan includes a domain, you can register a new one or bring the one you already have to Taraceista. You can also connect to your website a domain that stays with your provider: then you keep managing it there, and the only part of this section that affects you is what your provider says.
- Registrar and holder: we register and transfer domains through Openprovider (Hosting Concepts B.V., Netherlands), an accredited registrar. You are the holder: the domain is in your name and with your details. Some domains registered before 19 October 2026 are with another accredited registrar, also in your name.
- The terms of each extension: when you ask for a domain or its transfer you also accept those of the registry of that extension, which you see linked next to the checkbox. For .es and .com.es, the Red.es terms and their Annex III. For .eu, EURid's. For .com, .net and .org, the Openprovider registration agreement, ICANN's registrant benefits and responsibilities and the registry agreement of that extension. We keep which version you accepted and when.
- Your holder details must be true and up to date, because they are the ones in the registry. For .com, .net and .org the registrar sends you an email to confirm them: if you do not confirm within fifteen days, the domain may be suspended.
- Which extensions: you can only ask for those included in your plan, and the domain counts as your plan's domain.
- Renewal: while your plan is active and up to date, we renew the domain before it expires, without charging you anything extra. You do not have to do anything.
- If you cancel or your plan is not up to date, we stop renewing it. The domain stays in your name until its expiry date, and until then you can take it to another provider. If it expires without being renewed, it is subject to the rules of its registry, and you may lose it.
- Bringing it to Taraceista: if your domain is with another provider, you unlock it there for transfers, ask for the authorisation code (also called EPP code or authcode) and enter it in the panel. If it has DNSSEC, you turn it off first. Before requesting the transfer we copy its records to our servers (the website, the email and the subdomains you tell us) and check that they answer the same, so that nothing is cut off. What cannot be seen from outside cannot be copied: that is why you can add your subdomains when you request it. Transferring a .com, .net or .org adds one year to its expiry. Transferring a .es is free and does not change its date, and Red.es sends you an email that you have to confirm within ten days.
- Lock periods: under ICANN rules, a .com, .net or .org cannot be transferred to another registrar until 60 days after its registration or its last transfer. This applies to bringing it and to taking it away afterwards. .es and .eu follow the rules of Red.es and EURid.
- Taking it elsewhere: you can do it whenever you want, also without cancelling. Write to us at hola@taraceista.com from your account email: we unlock it and give you its authorisation code within five days at most. With that code you request it at your new provider.
7. Payment, renewal and cancellation
- Payment is in advance, by card through Stripe, at the start of each monthly or annual period.
- The monthly plan has no fixed term: it renews every month until you cancel it. The annual plan renews for another year, and we let you know by email at least fifteen days before.
- You can cancel at any time from the panel. Cancellation takes effect at the end of the paid period, and until then the service keeps working. There is no minimum term or penalty.
- If a payment fails, we let you know. If it is not resolved within fifteen days, we may suspend the service until it is paid.
- If you change plan, the panel tells you before confirming how much is charged or discounted.
- If we change a price, we will let you know thirty days in advance and you can cancel before it applies. A period already paid does not change price.
8. Your content
The texts, photos, data and other content you provide are yours. You give us permission to host them, adapt them to the website and publish them, only to provide the service and while it lasts.
You are responsible for what you publish, and you undertake that:
- you have the right to use it;
- it is not unlawful or misleading and does not infringe the rights of others, such as intellectual property, reputation or data protection;
- it is not used to impersonate anyone, defraud, spread malware or send unsolicited commercial email;
- you comply with what the law requires of you as a business: your legal notice, your privacy policy and, if you sell, your terms of sale.
9. Artificial intelligence
In the workshop you talk to an artificial intelligence system, and the texts and images of your website are generated by that system from what you tell it. It can make mistakes. Check what it generates before publishing it, especially prices, opening hours and contact details. We do not guarantee that the generated content is accurate or that the website will bring sales, visits or a particular position in search engines.
You can use the texts and images generated for your website commercially. The system may refuse to generate content it considers unlawful.
10. The call «Explain it to us by phone!»
When you create your website you can ask us to call you so you can tell us about your business by voice. You are called by an automated voice assistant, which is an artificial intelligence system and introduces itself as such at the start. That way you know from the beginning that you are talking to an artificial intelligence, as the European Artificial Intelligence Act requires. It asks you about your business to prepare your website. The call lasts a few minutes, six at most.
- To ask for it you tick a mandatory checkbox. With it you declare that the number is yours or that you have its holder's permission, and you agree to be called by an automated assistant and to have the conversation transcribed.
- What the assistant notes down is used as the request to create your website. Check the result like everything else the artificial intelligence generates (section 9).
- The call may come from a Taraceista number or from a test number. The assistant always says it is calling from Taraceista.
- To prevent abuse, each account can ask for a few calls a day. We only call numbers in Spain and some European countries, and never premium-rate numbers.
- You may not give someone else's number without their permission or use the call to bother anyone. If that happens, we may block the feature or the account.
- The audio is not recorded. What we keep, why and for how long is in the privacy policy.
11. Who owns the website
The code, texts and images of your website are yours. The platform (the builder, the panel, the workshop and everything that makes them work) is ours, and is not transferred with the website.
From the first payment you can download your website. When you leave:
- You take with you the website (code, texts and images), the domain (section 6) and the form submissions you have, in a file.
- You do not take with you what depends on our servers: the forms stop receiving submissions, the statistics switch off and there is no longer a workshop to change it.
12. Use of the platform
You may not:
- resell the service or give others access to your account as if it were a service of yours;
- access it by automated means, get around the plan's limits or put the service of others at risk;
- decompile or try to reproduce the platform, except as the law allows.
An account belongs to one person or one business. Keep your details up to date and tell us if you think someone has got into your account.
13. Reporting content
Anyone can report content hosted on Taraceista that they believe is unlawful by writing to hola@taraceista.com with: the exact address of the content, why they believe it is unlawful, their name and email (except in cases of child sexual abuse), and a statement that what they say is true.
- We acknowledge receipt, and each report is reviewed by a person, without automated tools.
- Except in urgent cases, we pass it on to the customer so they can explain or remove it.
- If we remove or restrict content, we explain it to the customer with the reasons, and we tell the person who reported it what we have decided. Both can ask us to review it again or go to court.
- If content suggests a crime that threatens someone's life or safety, we inform the authorities.
14. Suspension and end of the contract
We may suspend a website or an account for:
- non-payment, after the fifteen days in section 7;
- content that is unlawful or breaches these terms;
- use that puts the service or third parties at risk.
We will give notice beforehand whenever possible, with the reasons. Suspending is not deleting: the data is kept for thirty days in case it is resolved. If the breach is serious or continues, we may terminate the contract. If one day we stop providing the service, we will give at least thirty days' notice so that you can take your website with you.
15. If you are a consumer
If you sign up outside your professional activity, you have fourteen calendar days from your first payment to withdraw from the contract without giving reasons. When signing up you ask us to start the service straight away; therefore, if you withdraw, you pay the proportional part of the service provided until then and we refund the rest within fourteen days, by the same means of payment.
To withdraw, write to us at hola@taraceista.com from your account email. You can use this model, although it is not mandatory:
«To Jesús Marín Almansa (Taraceista), Calle Alondra, 13, 2.º E, 18014 Granada, Spain, hola@taraceista.com: I hereby give notice that I withdraw from my contract for the Taraceista service, plan [plan name], signed up on [date]. Name: [your name]. Account email: [your email]. Date: [date].»
Nothing in these terms limits the rights the law gives you as a consumer, including the legal guarantee of conformity for digital services.
16. Availability and liability
We work to keep the service always available, but we do not guarantee a percentage: there may be maintenance and provider failures.
We are liable for the damage we cause by breaching these terms. If you sign up as a business or professional, we are not liable for loss of profit or indirect damage, and our total liability is limited to what you have paid us in the previous twelve months. These limits do not apply in case of wilful misconduct or gross negligence, or to consumers.
Third-party services you add to your website (maps, payments, videos, messaging) are governed by their own terms.
We are not liable for what cannot be avoided or foreseen, such as a general internet outage or an order from an authority.
17. Personal data
How we process your data is in the privacy policy.
For the data of your website's visitors (forms, statistics and domain email) you are the controller and we are your processor. That processing is governed by the annex below.
18. Changes to these terms
We may change them because of changes in the law, in the service or in prices, or for security reasons. If the change is significant, we will let you know by email thirty days in advance, and if you do not agree you can cancel at no cost before it applies.
19. Notices, complaints and applicable law
- We communicate by email: we write to your account email; you write to hola@taraceista.com. Complaints are answered within fifteen days at most.
- If you are a consumer, you can also go to the consumer services of your autonomous community or to the consumer arbitration board.
- If a clause were void, the rest remains in force.
- Spanish law applies. If you are a consumer, the courts of your place of residence have jurisdiction. If you sign up as a business or professional, those of Granada.
Annex: data processing
It applies to the personal data we process on your behalf (Article 28 GDPR) for as long as the contract lasts.
- What: hosting your website, receiving and storing its forms, counting its visits and, if you have it, managing your domain email.
- Data and data subjects: what your business's visitors and customers write in your forms or send you by email, and the technical data of their visits.
- Instructions: we process that data only to provide the service and following your instructions, which are these terms and what you set up in the panel. We do not use it for anything of our own.
- Confidentiality and security: whoever accesses it is bound to secrecy, and we apply the security measures described in the privacy policy.
- Sub-processors: you authorise the providers in the privacy policy. If we add or change one, we will let you know beforehand and you can object by cancelling.
- Assistance: we help you respond to data subjects' rights and, if there is a security breach affecting that data, we let you know without undue delay.
- At the end: you can ask for your submissions before you leave. Afterwards they are deleted, except what the law requires us to keep.
- Audit: we will give you the information needed to show that we comply with this annex.
